MAINE'S USDA FOOD PROGRAM

The USDA Food Program

            This program is administered at the federal level by the U.S. Department of Agriculture. Its purpose is to provide food to various eligible outlets, specifically the school lunch program, needy people in tax-exempt, non-profit institutions, young people in non-profit summer camps and child care agencies. In providing such assistance, USDA supports selected products in the open market by large scale purchases and removes certain food products acquired by the Commodity Credit Corporation (CCC). An expressed preference of the recipient agencies determines which foods are purchased on the open market. Section 6 of the National School Lunch Act, Section 416 of the Agricultural Act of 1949, and Section 32 of Public Law 74-320 designate funds for such purchases.

            A contractual agreement made with each state provides for a Distributing Agency and for the implementation of USDA rules and regulations.

            The USDA offers foods to each State Distributing Agency (DA). When such an agency accepts the commodities in amounts offered or desired, food requisitions are prepared and sent to the USDA showing the location to which product should be sent and the preferred delivery date. Then, USDA ships products to the state warehouse and the State DA confirms shipment to USDA.

            The State DA provides letters of offering to recipient agencies on a regular basis. All agencies have the opportunity to accept or reject the offered commodities. With the return of such offering, shipping tickets are processed and sent to the warehouse. The warehouse acts as an agent for the State DA in the receipt and distribution of commodities. Recipient agencies receive bills for the storage, handling and delivery of the USDA Foods they order. If preferred, a recipient agency may pick up USDA Foods at the warehouse.

            Recipient agencies should sign for products accepted in good condition. Any Exceptions should be noted on the delivery slip.

            Recipient agencies must keep records supporting receipts for a minimum period of three years. Books and records having to do with the receipt and use of commodities are subject to audit by the State DA or representatives from USDA.

            Our agreement with recipient agencies specifies, among other things, that USDA Foods will be accepted in such quantities as can be fully used, and that they will not be traded, sold, or otherwise disposed of without approval of the State DA. Loss or damage to USDA Foods are to be reported to the State DA.

            USDA food may also be processed, with the approval of the DA, into other products desired by recipients. Such products may include bread products, pizzas and salad dressings. The products are sold and distributed just as any other commercial product except that recipient agencies receive a discount equal to the value of USDA Foods involved.
