License Types
The Department shall issue the following types of licenses:
A. Provisional license. A provisional license shall be issued by the Department to any applicant who meets all of the following:
- Has not previously operated the facility for which the application is made or is licensed but has not operated during the time of that license;
- Complies with all applicable laws and rules, except those which can only be complied with once clients are served by the applicant; and
- Demonstrates the ability to comply with all applicable laws and Rules by the end of the provisional license term.
B. Full license. The Department shall issue a full license to an applicant who, in the Department's determination, complies with all applicable laws and Rules.
C. Conditional license. A conditional license may be issued by the Department when the licensee or applicant fails to comply with the applicable law and rules and, in the judgment of the Commissioner, the best interest of the public would be so served by issuing a conditional license. D. Temporary license. A temporary license may be issued by the Department whenever a licensed Child Care Facility moves to a new location. The Department may issue a temporary license, valid pending final action on the application for the new location when:
- All applicable standards have been met except a requirement that is dependent on the action of an agency of state government or a contractor of that agency; and
- Through no action by the applicant that causes a significant delay, timely issuance of a provisional or full license has been delayed by the agency or contractor.
