RE: Potential Impact of the Government Pension Offset (GPO) and Windfall Elimination Provision (WEP)
I recently received a letter from Reg Weaver, President of the National Education Association asking that I remind you of the Social Security Protection Act of 2004 and specifically Public Law 108-203, which requires employers to notify employees about the potential impact of the Government Pension Offset (GPO) and Windfall Elimination Provision (WEP) on their Social Security benefits.
Section 419(c) of Public Law 108-203, the Social Security Protection Act of 2004, requires the notification of all employees hired on or after January 1, 2005 of this potential impact. It also requires impacted employees to sign a statement indicating that they have received notice of this potential impact on their retirement.
The required notice and certification have been drafted by The Social Security Administration and can be found online at: http://www.ssa.gov/form1945/
I have also included a link to Section 419(c) of Public Law 108-203, the Social Security Protection Act of 2004, for your information. This law can be found at:
Thank you for your continued attention to this important matter.
