Public Notice on Waiver of Section 421(b) Tydings Amendment for obligation period of
ESEA State-administered federal 2009 [State FY10] funds

 

On behalf of the school administrative units that commented on the September 27, 2011 email regarding the need to extend the obligation period for federal 2009 [State FY10] ESEA State-administered funds, the Maine Department of Education is applying to the U. S. Department of Education for a waiver to Section 421(b) of the General Education Provisions Act (GEPA) to extend the obligation period through September 30, 2012.

This waiver would permit the sub-recipients to continue to obligate these federal 2009 [State FY10] ESEA State-administered funds from the date of the U. S. Department of Education’s approval of the waiver until June 30, 2012 in accordance with applicable program requirements and paperwork on file with the Maine Department of Education.  At this time, school administrative units do not have authority to obligate their federal 2009 [State FY10] funds after September 30, 2011 unless and until the U. S. Department of Education approves the Maine Department of Education’s state waiver request.

Lewiston School Department
Orrington School Department
MSAD 58
MSAD 59
MSAD 64
RSU 20
