Maine Health Care Workers: Listing for Verification of Legal ProtectionSeptember 15, 2009
Verification of Legal Protections for Maine Health Care WorkersOn September 1, 2009, Governor Baldacci issued a Civil Emergency Proclamation Due to a Highly Infectious Agent pursuant to 37-B MSRA sections 703, 741, 742, 784-A and 822. 37-B MRSA Section 784-A states, “A health care worker licensed in this State designated by the Maine Emergency Management Agency to perform emergency management or health activities in this State in a declared disaster or civil emergency pursuant to section 742 …. is deemed to be an employee of the State for purposes of immunity from liability pursuant to this section …. and for purposes of workers’ compensation insurance pursuant to section 823….” The Director of the Maine Emergency Management Agency has designated certain health care workers to participate in the administration of H1N1 Flu vaccinations. These persons include licensed EMS personnel that have received the appropriate vaccination training as certified by State EMS authorities. Certain other health care workers that have enrolled at the Maine Responds web site and have appropriate credentials as certified by the Maine CDC have also been designated. These designations will remain in effect until the expiration of the current or subsequent related declarations, unless modified by the Maine Emergency Management Agency. Persons not on either of these lists should not assume they have the protections outlined above. Persons that feel their name should be added to either of the lists should contact:
