NOTICE

The Maine State Employees Association, SEIU Local 1989 and the State of Maine, Judicial Branch have filed a duly executed Agreement on Appropriate Bargaining Unit (MLRB Form 1) with this office memorializing their agreement that the following described Judicial Law Enforcement Services Bargaining Unit is appropriate for the purposes of collective bargaining:

    INCLUDED: Deputy Judicial Marshals; Sergeant, Judicial Marshals; and Captain, Judicial Marshals.
    EXCLUDED: All other employees of the State of Maine, Judicial Branch including, but not limited to, all other employees in the Administrative Services Bargaining Unit and the Supervisory Services Bargaining Unit.

The purpose of the Agreement is to remove the positions of Deputy Judicial Marshal and Sergeant, Judicial Marshals from the Administrative Services Bargaining Unit and to remove the position of Captain, Judicial Marshals from the Supervisory Services Bargaining Unit and to place these removed positions into a newly-created and separate Judicial Law Enforcement Services Bargaining Unit. Other elements of the parties’ agreement regarding this new unit are as follows:

    Except as noted below, this agreement is contingent on the parties’ further agreement that the existing (2009-2011) collective bargaining agreement with respect to the Administrative Services Bargaining Unit shall apply to the Law Enforcement Services Bargaining Unit for the duration of that agreement, unless and until the parties negotiate and execute a successor to that agreement specifically applicable to the Law Enforcement Services Bargaining Unit. It is the parties’ intent to commence negotiations over the collective bargaining agreement for the Law Enforcement Services Bargaining Unit prior to the expiration of the Administrative Services collective bargaining agreement.
    In addition, as an exception to the general rule noted in the paragraph above, this agreement is contingent on the parties’ agreement that the existing (2009-2011) collective bargaining agreement with respect to the Supervisory Services Bargaining Unit shall apply to the Captain position for the duration of that agreement, even though that position is now in the Law Enforcement Services Bargaining Unit, unless and until the parties negotiate and execute a successor to that agreement specifically applicable to the Law Enforcement Services Bargaining Unit. It is the parties’ intent to commence negotiations over the collective bargaining agreement for the Law Enforcement Services Bargaining Unit prior to the expiration of the Supervisory Services collective bargaining agreement.
    The parties agree further that, subject to the collective bargaining process, they intend to include an addendum to the Law Enforcement Services Bargaining Unit agreement to address issues specific to the supervisory roles of Sergeants and Captains.

The Maine Labor Relations Board has ordered that this Notice be posted for at least seven (7) calendar days at all work locations where notices are customarily posted for the benefit of employees of the State of Maine, Judicial Branch.

Should any employee or other person dispute the appropriateness of the unit described above or have questions or concerns regarding the bargaining unit agreement, they may contact the Board office between 8:00 a.m. and 5:00 p.m., Monday through Friday.
