The insureds requested a hearing following receipt of a notice of nonrenewal of their homeowners policy citing a dog bite incident that occurred during the policy term. At hearing, it was determined that the company had issued a full, unconditional renewal of the policy subsequent to its issuance of the nonrenewal notice and to its receipt of the Superintendent’s notice of hearing and provisional coverage order.

Held: For the insured. The unconditional renewal effectively negated the insurer’s prior notice of intent not to renew.
