Gloria Gregoire v. Middlesex Mutual Assurance Company

Held October 21, 2008 - Docket No. INS-08-2099
Decision Issued: October 23, 2008

The insured contacted the Bureau of Insurance to protest the company’s nonrenewal of her homeowners policy for failure to comply with loss control recommendations.

Held: For the company. 24-A M.R.S.A. § 3049(10) allows an insurer to cancel or nonrenew a homeowners policy if the insured fails to comply with reasonable loss control recommendations within 90 days after notice of the necessary loss prevention measures. The company demonstrated that recommendations were issued to the insured in July 2007, and that at least one justifiable recommendation had not been completed as of an inspection in August 2008.
