Donald and Ginette Vaillancourt v. Liberty Mutual Fire Insurance Company

Held May 13, 2009 – Docket No. INS-09-2032
Decision Issued: May 20, 2009

The insured requested a hearing to contest the nonrenewal of a homeowners policy for a dog bite loss. The company demonstrated that payments were made as a result of the incident, and the insureds still have the dog.

Held: For the company. 24-A M.R.S.A. § 3049(9) permits cancellation or nonrenewal if a loss has occurred from a dog bite unless the insured has removed the dog. As the company documented the loss from the incident and the insureds still have the dog, the nonrenewal is permitted under Maine law.
