Patrons Oxford Insurance CompanyHeld November 5, 2009 – Docket No. INS-09-2109 The insureds requested a hearing to contest the company’s cancellation of their homeowners insurance for failure to comply with loss control recommendations. The company established that the recommendations were reasonable to prevent potential losses covered under the policy and that the recommendations had not been done. Held: For the company. 24-A M.R.S.A. § 3049(10) allows cancellation of a homeowners policy for failure to comply with reasonable recommendations within 90 days after notice from the insurer. The company complied with all elements of the Maine Property Insurance Cancellation Control Act, therefore the cancellation is permitted under Maine law.
