Patrons Oxford Insurance Company Held October 25, 2011 - Docket No. INS-11-2070 The named insured requested a hearing to contest the nonrenewal of their homeowners policy for an increase in hazard due to a change in occupancy. The company demonstrated that the location is the primary residence of a relative but not of the named insureds. Held: For the company. The Maine Property Cancellation Control Act permits nonrenewal for a reason that is in good faith and related to the insurability of the property. As the company established that occupancy by someone other than the named insured/owner is an increase in hazard, the nonrenewal action is permitted.
