DEPARTMENT OF PROFESSIONAL AND FINANCIAL REGULATION BUREAU OF INSURANCE
As part of the Applicants Initial Consolidated Filing, the Applicants requested that financial projections for Anthem BCBS submitted with that filing should be treated as confidential because such projections are (1) excepted from disclosure under the Maine Freedom of Access Act, 1 M.R.S.A. §§ 401-410, and (2) privileged pursuant to M. R. Civ. P. 26 (c), M. R. Evid. 507, and 10 M.R.S.A. § 1542(4) because they are trade secrets and otherwise competitively sensitive. (See September 15, 1999 letter from James B. Zimpritch, pp. 4-5.) The Superintendent agreed with this analysis and, by Protective Order dated October 19, 1999, accepted as confidential financial projections for Anthem BCBS. (See October 19th Protective Order, ¶6.) Also in the September 15th filing letter, the Applicants advised that additional financial projections for Anthem BCBS would be filed by supplement. (See September 15, 1999 letter, p.2.) Consistent with the earlier request and the Superintendents prior ruling, Anthem now requests confidential treatment for portions of the financial projections for Anthem BCBS, filed this day as a supplement to the Applicants September 15, 1999 Form A filing and titled "Anthem, Inc. Acquisition of BC/BS Maine Proforma Income Statement for Years Ended December 31, 1998-2003," (AN-02052). As reflected in the title, in addition to actual income results for 1998, this filing contains financial projections for Anthem BCBS for years 1999-2003. For the same reasons articulated in the Applicants September 15th filing letter, this information is privileged from disclosure because it reflects proprietary business projections and is competitively sensitive, as from it a competitor could obtain valuable information about Anthems and Anthem BCBS future business plans and activities. Accordingly, Anthem requests that the Superintendent designate the 1999-2003 financial projections for Anthem BCBS as confidential, subject to disclosure only under the terms of the Protective Order and exempt from disclosure under the FOAA.
