Minutes of February 24, 2003 Public Board Meeting

- CALL TO ORDER
The Board was called to order by Ted Chaffee, Chair at 9:00 a.m.
- MOTION FOR STAY
The Board received a motion for stay of sanctions from Michelle Cobb. Cheryl Davis did not participate as she was the complaint officer for this case. Ted Chaffee recused as he was not involved in the prior hearing. The Board was asked to consider three reasons for granting the motion. Would irreparable harm be done to the petitioner, was there a strong likelihood of success on the merits, and would there be harm to the public? Polly Burgess motioned to deny the motion for stay on the grounds that the three reasons had not been met. Karen St. Clair seconded. Motion passed with 4 in favor, 1 opposed (Reid Stevens) and 2 recusals (Ted Chaffee and Cheryl Davis).
- APPROVAL OF MINUTES
Cindy Woodard moved to accept the minutes of January 27, 2003 and Karen St. Clair seconded. Passed unanimously.
- ADMINISTRATOR’S COMMENTARY
Anne Head spoke to the Board regarding the search for another administrator.Anne also referred to legislation being looked at (LD 175). She has sent a letter to the legislature explaining that LPCs do not have clinical status. Reimbursement of LCPCs is being looked at through the Bureau of Insurance to be considered by the legislature for mandating all insurance companies pay LCPCs.
- COMPLAINT PRESENTATIONS
COU-108: Discussion of actions of a foster parent who is also an LCPC. The feeling is that this is a DHS matter not one covered by this Board. Cindy Woodard moved to dismiss the complaint and Polly Burgess seconded. Motion passed with 5 in favor and 1 recusal (Cheryl Davis).
COU-105: Consent agreement with board approved supervision was followed using Jeri Stevens as the supervisor has been completed. Reid Stevens moved to close the complaint. Polly Burgess seconded. Motion passed unanimously.
Discussion regarding two adult sisters, one goes for counseling and the other files a complaint against the licensee. Discussion was held regarding the case being dismissed as without a release from the client the complainant has no right to receive the client’s record. The Board discussed forwarding a letter to the complainant stating the aforementioned.
- LICENSE APPLICATIONS AND RENEWALS
Cindy Woodard moved and Karen St. Clair seconded, to approve the new licenses as listed. Passed unanimously.
Cynthia Woodard moved and Karen St. Clair seconded, to deny the licenses as listed. Passed unanimously.
Cindy Woodard moved and Karen St. Clair seconded, to approve the renewals as listed. Passed unanimously.
- SUPERVISOR APPROVALS
Cindy Woodard moved and Polly Burgess seconded, to approve Mary Haynes as Maynard Jalbert’s supervisor. Passed unanimously.
Polly Burgess moved and Cindy Woodard seconded, to approve Phil Monaco as Mary-Ellen Ostherr’s supervisor. Passed Unanimously.
Polly Burgess moved and Reid Stevens seconded to approve Beth VanGorden as Kathleen Dulas’ supervisor. Passed Unanimously.
Polly Burgess moved and Cindy Woodard seconded to approve Margaret Rode as Pauline Miller’s supervisor. Passed Unanimously.
Polly Burgess moved and Reid Stevens seconded to approve Kendra Bryant as Pauline Miller’s supervisor. Passed Unanimously.
Polly Burgess moved and Cindy Woodard seconded to approve Kendra Bryant as Nancy Biscone’s supervisor. Passed Unanimously.
- MISCELLANEOUS
Discussion took place regarding a person applying now with a degree that may be less than a 45 hour degree. Applications are acceptable until July 1, 2003 only.
There was discussion regarding giving Diane guidelines for approving applications and renewals in the near future. The guidelines should include educational worksheets for UMO, USM, Lesley, and Antioch colleges. Diane could begin approving a percentage of the applications and renewals sent in. Reid Stevens has agreed to work on Lesley College’s worksheet and Cheryl will work on Antioch. Cindy Woodard moved for Diane Staples to review application with transcripts from UM and USM and Registrations. Karen St. Clair seconded. Motion passed unanimously.
The Board needs to continue revamping the Rules. Cheryl will review the work that has been revamped previously.
