Minutes of June 23, 2003 Public Board Meeting

  1. CALL TO ORDER

    The Board was called to order by Ted Chaffee, Chair at 8:55 a.m.

  2. APPROVAL OF MINUTES

    Cheryl Davis moved to approve the minutes of the May 19, 2003.  Cynthia Woodard seconded the motion.  The motion passed unanimously.

  3. ADMINISTRATOR’S COMMENTARY

    Anne Head joined the Board to discuss the Administrative Procedures Act and the section that allows affected individuals to ask for legislative review of a rule that is adopted or applied.   Nicole Gagne via her attorney is asking for legislative review of the Board’s rule and its application.  What has happened over time is defacto rules, according to the attorney.  Notification of applicants needs to be in a meaningful way.  The Board has the right to require a single 45 credit program but needs to be changed in the rule changing process and the July 1, 2003 deadline is not defensible.  Anne Head recommends the Board look at this one issue for a rule change and go forward to expedite the process. 

    Nicole Gagne’s attorney was present and asked the Board to consider looking at her application for comity, not for comity analysis but to see if an applicant has the background and information for an initial application under comity.  This is not an appeal.  She has filed a new application for comity.  Anne Head asked the Board to consult with her attorney if we have questions and look at the packet under both comity and standard application.

  4. APPEAL HEARING

    Laurence Ouellette:  Cheryl Davis moved to uphold the denial on items 1, 2, and 3, and grant the appeal on items 4 and 5.  David Bellville seconded the motion.  The motion passed unanimously.

  5. LICENSE APPLICATIONS AND RENEWALS

    Cheryl Davis moved and Cindy Woodard seconded, to approve the new licenses as listed.  Passed unanimously.

    Cindy Woodard moved and Cheryl Davis seconded, to deny the licenses as listed.  Passed unanimously.

    Cindy Woodard moved and David Bellville seconded, to approve the renewals as listed.  Passed unanimously.

  6. COMPLAINT PRESENTATIONS

    COU-113:  Scott Hutcherson moved and Reid Stevens seconded to offer the licensee a consent agreement as discussed.   Motion passed with 6 in favor and 1 recusal (Cheryl Davis).

  7. INACTIVE STATUS

    Cynthia Woodard moved and Cheryl Davis seconded to grant inactive status to Susan Metters.  Motion passed unanimously.

  8. MISCELLANEOUS

    David Bellville moved and Cheryl Davis seconded to proceed with rulemaking to change the wording in the section requiring a 45 hour single master’s degree program.  Discussion took place regarding notifying the educational institutions, updating the website, and notifying the professional associations.  Motion passed unanimously.

  9. ADJOURN

     -The meeting adjourned at 4:30 p.m.
