Minutes of October 27, 2003 Public Board Meeting

Members Present:

  • Cheryl Davis. LCPC
  • Polly Moutevelis-Burgess, LCPC

  1. CALL TO ORDER

    The Board was called to order by Ted Chaffee, Chair at 9:00 a.m.

  2. APPROVAL OF MINUTES

    Cindy Woodard moved to approve the minutes of the September 22, 2003. Scott Hutcherson seconded the motion.  The motion passed with 6 in favor and 1 abstention (Polly Moutevelis-Burgess).

  3. ADMINISTRATOR’S COMMENTARY

    Anne Head discussed changing the statute and then changing the rules after that regarding the 45 hour degree reference that has been deleted.  More pathways to clinical licensure have been added.  The legislature is slated to review the act in January 2004.

    Penny referred to a letter sent to the Governor’s office with a complaint regarding how an applicant’s hearing was handled.

    Penny suggested waiting to start on-line renewals.

    Penny cannot attend the January conference.  Polly is interested in attending.  The Board voted to send Polly to the conference.

    Penny added that the November meeting is slated for the fee structure to be reviewed by the board.

  4. APPEAL HEARING

    Susan Cohen: Karen St Clair conducted the hearing as Chair.  Cheryl Davis moved to uphold the denial on items 1, 2, 3 and 7 and to grant the appeal on items 4, 5, 6, and 8.  David Bellville seconded.  Motion passed unanimously.

    Leslie Mulligan-McMichael: Ted Chaffee conducted the hearing as chair. Cheryl Davis moved to uphold the denial on count 2 and grant the appeal on 1 and 3.  Motion seconded by David Bellville.  Motion amended by Cheryl Davis to grant the appeal on all counts, seconded by David Bellville.  Motion passed with 7 in favor and 1 opposed (Cindy Woodard).

  5. COMPLAINT PRESENTATIONS

    Cou-111: Cindy Woodard moved to dismiss the complaint based on no violation of the laws and rules.  Polly Moutevelis-Burgess seconded.  Motion passed with 7 in favor and 1 recusal (Cheryl Davis).

    Cou-119: Karen St. Clair moved and Scott Hutcherson seconded to offer a consent agreement based on violations of Board Rules Chapter 8 Section 3(A)(3) and 3(B)(3) and to require admission, reprimand, $250 fine and supervision.  Motion passed with 7 in favor and 1 recusal (Cheryl Davis).

    Cou-120:  Karen St. Clair moved and Scott Hutcherson seconded to offer a consent agreement based on violations of Board Rules Chapter 8, Section 3(A)(3), 3(C)(2), and 3(D)3 with admission, reprimand, suspension of 6 months, and supervision of 1 year after the suspension covering ethics and boundaries. Motion passed with 7 in favor and 1 recusal (Cheryl Davis).

  6. LICENSE APPLICATIONS AND RENEWALS

    Karen St. Clair moved and David Bellville  seconded, to approve the new licenses as listed.  Passed unanimously.

  7. SUPERVISOR APPROVALS

    Cindy Woodard moved and David Bellville seconded to approve Katharine Bloom’s request for approval of Judith Day as her supervisor. Motion passed unanimously.

  8. INACTIVE STATUS

    Doris Morgan: Scott Hutcherson moved and Karen St. Clair seconded to approve her request for inactive status.

  9. MISCELLANEOUS

    Reid Stevens offered to return to the office one day before the next meeting to review applications that did not get completed.  Scott Hutcherson will check his schedule to see if he can come in.

  10. ADJOURN

  1.  -The meeting adjourned at 4:30 p.m.
