Minutes of November 17, 2003 Public Board Meeting

- CALL TO ORDER
Cheryl Davis moved to approve the minutes of the October 27, 2003. Cindy Woodard seconded the motion. The motion passed unanimously.
- APPROVAL OF MINUTES
Cindy Woodard moved to approve the minutes of the September 22, 2003. Scott Hutcherson seconded the motion. The motion passed with 6 in favor and 1 abstention (Polly Moutevelis-Burgess).
- ADMINISTRATOR’S COMMENTARY
Carol Leighton joined the meeting in order to answer questions regarding Penny Vaillancourt’s presentation regarding the budget and the proposed increase in fees for the Board. The Board asked questions regarding the 50% increase in fees and Penny and Carol explained the budget process. The Board questioned the expenses and the allocation of time of administrative staff. The board is concerned that they have no authority to change the decision to raise fees. Penny encouraged the Board’s cooperation in supporting the department’s proposed rule changes. The Board feels that if they had a break down of expenditures so they developed an understanding that they could support the proposal better. Once they have seen the expenditures, then they will make a statement regarding the proposed fee increases.
The renewal form has been changed to include the disclosure statement question so as to move forward in the audit process for renewals. The Board discussed the new renewal form and wanted wording added that pointed to the breakdown in the rules of the ceu requirement. Polly Moutevelis-Burgess moved and Reid Stevens seconded to approve the new renewal form. Motion passed unanimously.
- APPEAL HEARING
Anna Peterson: Cheryl Davis made a motion to uphold initial denial on the grounds numbered 1 through 6 and 10 and to reverse the initial denial on the grounds numbered 7 through 9 set forth in the Notice of Hearing. Scott Hutcherson seconded. Motion passed unanimously.

LICENSE APPLICATIONS AND RENEWALS
Reid Stevens moved and Cheryl Davis seconded, to approve the new licenses as listed. Passed unanimously.
Polly Moutevelis-Burgess moved and Cindy Woodard seconded, to deny the licenses as listed. Passed unanimously.
Polly Moutevelis-Burgess moved and Cindy Woodard seconded, to approve the renewals as listed. Passed unanimously.

COMPLAINT PRESENTATIONS
No complaints to be heard this month.
- SUPERVISOR APPROVALS
Cindy Woodard moved and Polly Moutevelis-Burgess seconded to approve new supervisors as presented.
- INACTIVE STATUS
Reid Stevens moved and Polly Moutevelis-Burgess moved to approve inactive status for Nancy Markowitz.
- MISCELLANEOUS
Discussion regarding supervision with a goal of consistency among applicants. The rules say supervisor must have at least five years of counseling experience. Judy’s opinion is that this is licensed experience.
Scott says this is a higher bar that the national association and other states requirements. The Board decided that the five years of experience needs to be licensed experience, but can include the conditional licensure.
An appellant disclosed that she has been seeing clients under the supervision of a licensee. The advice of the AAG is that a complaint is filed against the supervisor for facilitating unlicensed practice. Cindy Woodard moved and Cheryl Davis seconded to file a complaint against the supervisor based on information provided at the license denial appeal hearing. Motion passed unanimously.
