Minutes of March 22, 2004 Public Board Meeting

The Board was called to order by Theodore Chaffee, Chair at 8:40 a.m.
- APPROVAL OF MINUTES
Cindy Woodard moved to approve the minutes of the February 23, 2004 with corrections. Polly Moutevelis-Burgess seconded the motion. The motion passed unanimously.
- APPEAL HEARING
Connie Saindon: Appeal hearing for LCPC by comity.
- ADMINISTRATOR’S COMMENTARY
Penny Vaillancourt provided the board with information that the board will require all applicants effective July 1, 2004, to submit a HIPDB report along with the other required application materials to ensure that any information regarding disciplinary action has been collected prior to licensing an individual in this state. Additional changes will be made to the application forms, including the Supervision Plan to eliminate confusion to applicants regarding this requirement.
- LICENSE APPLICATIONS AND RENEWALS
Polly Moutevelis-Burgess moved and Karen St. Clair seconded, to approve the new licenses as listed. Passed unanimously.

- COMPLAINT PRESENTATIONS
Update on COU-109 and COU-116: This matter involves a consent agreement requiring the licensee to obtain supervision from a LCPC with experience in substance abuse. Licensee submitted a pastoral counselor to do the supervision based upon difficulty finding an LCPC. This licensing designation does not comply with the language of the consent agreement. Reid Stevens moved and Karen St. Clair seconded that another letter be sent to the licensee regarding complying with the original consent agreement and allowing another 30 days to comply. Motion passed unanimously.
Update on COU-077: Cindy Woodard moved to close the complaint and Scott Hutcherson seconded. Motion passed unanimously.
Reconsideration of Initial Presentation of Cou-119: The Board received additional complaint materials pursuant to communications between Judy Peters, AAG, and the licensee’s attorney. The licensee’s attorney alleged that the initial presentation was presented to the board in a “biased and prejudiced manner” and requested the board to either dismiss the matter or refer it directly to District Court. The board considered the additional information and did not consider the original presentation to be biased or prejudiced. Polly Moutevelis-Burgess moved to offer the original consent agreement as was originally offered at its October 27, 2003 meeting. Cindy Woodard seconded. Motion passed with six in favor and 1 recusal (Cheryl Davis).
- SUPERVISOR APPROVALS
Karen St. Clair moved and Polly Moutevelis-Burgess seconded to approve Thomas Kivler as Sandra Shuman’s supervisor.
Moved and seconded to approve Brian Selby as Alwyn Brittain’s supervisor.
- CORRESPONDENCE
E-mail communication from Mr. Hunter dated March 8, 2004, regarding licensure requirements for pastoral counselors. The board reviewed Anne Head’s response as Both accurate and appropriate.
- MISCELLANEOUS
The Board agreed to schedule a disciplinary hearing on the dates of June 21 and 22, 2004. Diane Staples will e-mail the board members after the meeting to confirm the dates.
Patricia Morini: Ted Chaffee, Cheryl Davis and Judy Peters sent a letter to the licensee to respond to the board in writing to information it received indicating that the licensee was working as an LCPC while currently under licensure suspension pursuant to a recent Decision and Order. The licensee responded to the letter indicated that she is currently working in an agency, but is not providing counseling services. The board accepted the licensee’s response as proof that she is not practicing while under suspension.
Polly Moutevelis-Burgess moved to send a letter requesting clarification if there is a personal or professional previous relationship with Jeri Stevens or Donna Jean Polman in regards to doing supervision and ethics education for Patricia Morini. Cindy Woodard seconded. Motion passed with 6 in favor and 1 recusal (Cheryl Davis).
Karen St. Clair has asked to be relieved of her duty as co-chair. Karen St. Clair nominated Reid Stevens and Cindy Woodard seconded. Motion passed unanimously.
Polly Moutevelis-Burgess moved and Cindy Woodard seconded to change the meeting time back to 8:30 a.m. Motion passed unanimously.
Cheryl Davis, complaint officer, provided an update regarding the appeal hearing for applicant, Anna Peterson. At the November hearing, Ms. Peterson indicated that she was employed by an LCPC in Newport and that she was receiving clinical supervision from another LCPC. This brought up the issue of unlicensed practice, and the Board voted to file a complaint against the applicant’s employer. Subsequently, the identified employer contacted Ms. Davis by phone to explain that the applicant was not an employee, and simply rented space from her. In addition, she was unaware that Ms. Person was not registered with the Board as well as being unlicensed. Ms. Davis consulted with AAG Judy peters and asked the LCPC to write a statement to that effect, which was received and presented to the Board at it’s February meeting. The Board reviewed the letter and accepted the LCPC’s statements. No complaint was filed against the LCPC. The Board requested that the letter be placed in the licensing file, and a copy to be sent to Ms. Peterson for her records. Further, the Board requested a similar letter from the LCPC identified as Ms. Peterson’s clinical supervisor in terms of explaining that relationship to the Board. Ms. Davis and Penny Vaillancourt, Board Administrator, will discuss how to proceed with Ms. Peters.
