Minutes of April 26, 2004 Public Board Meeting

The Board was called to order by Theodore Chaffee, Chair at 9:16 a.m.
- APPROVAL OF MINUTES
Scott Hutcherson moved to approve the minutes of the March 22, 2004 with corrections. Cindy Woodard seconded the motion. The motion passed unanimously.
- APPEAL HEARING
Joann Eaton: Reid Stevens moved to uphold the denial on counts 1 and 3 and grant the appeal on 2 and 4. Scott Hutcherson seconded. Motion passed unanimously.
Elizabeth Samenfeld-Specht: Cindy Woodard moved to grant the appeal on points 2-7. Polly Moutevelis-Burgess seconded. Motion passed unanimously. Scott Hutcherson moved to approve the application pending the results of exam. Polly Moutevelis-Burgess seconded. Motion passed unanimously.
- ADMINISTRATOR’S COMMENTARY
Penny Vaillancourt provided an update regarding Jeff Frankel’s progress on an initial draft of the proposed rules. Reid Stevens and Ted Chaffee will meet with Jeff Frankel and Penny Vaillancourt prior to submitting the draft to the Rules Committee.
- LICENSE APPLICATIONS AND RENEWALS
Cindy Woodard moved and Cheryl Davis seconded, to approve the new licenses as listed. Passed unanimously.
David Bellville moved and Cheryl Davis seconded, to deny the licenses as listed. Passed unanimously.
- INACTIVE STATUS
Cheryl Davis moved and David Bellville seconded to approve inactive status for Shirley Glubka. Motion passed unanimously.
- COMPLAINT PRESENTATIONS
Cou-120: Complaint against registered counselor. Board offered a consent agreement regarding dual relationship and dishonesty. Licensee wants to sign consent agreement admitting to the violations and surrender license and right to reapply to the board. Scott Hutcherson moved and Cindy Woodard seconded to approve the new consent agreement. Motion passed unanimously.
There was a question raised regarding Ms. Litchfield’s dual consent agreement with the Alcohol and Drug Board with consultation stipulation every other month with each board. This means quarterly reports would sometimes be for one session and sometimes for two sessions. The Board agrees that this is acceptable. The board would like to review her compliance at renewal time which is June. Diane will flag the file to hold the renewal if it has not already been sent.
Patricia Morini has sent in two reports from the personal therapist and from the ethics supervisor. The personal therapist, Carol Mitchell, has not indicated the lack of personal knowledge in her letter. Reid Stevens moved and Polly Moutevelis-Burgess seconded to accept Carol Mitchell if she provides a statement that she has no personal or professional previous knowledge of the licensee.
COU-113: Scott Hutcherson moved and Polly Moutevelis-Burgess seconded to approve a factual change to the consent agreement.
COU-109 and 116: Licensee wanted a pastoral counselor to perform consultation, but did also submit an LCPC. But the potential supervisor only has been licensed for two years. The board will not approve this supervisor due to the lack of experience. The Board will send a letter to the licensee requesting a supervisor who has a minimum of 5 years of licensed experience.
Cou-124: Initial complaint presentation regarding father of a minor child complaining that counselor is failing to comply with court order and has been unprofessional with him. Licensee is not bound by this court order just the parties. Complaint committee feels that requests from complainant regarding scheduling him for counseling were unrealistic and licensee said scheduling conflicts may not work. The complaint committee recommends dismissal due to no violation. Cindy Woodard moved and Scott Hutcherson seconded to dismiss the complaint. The motion passed with 5 in favor, 0 opposed, and 2 recusals (Cheryl Davis and Polly Moutevelis-Burgess).
- CORRESPONDENCE
The Board received correspondence from Jeri Stevens clarifying her supervisory relationship with Anna Peterson.
