Minutes of June 21, 2004 Public Board Meeting

  1. CALL TO ORDER

    The Board was called to order by Theodore Chaffee, Chair at 8:45 a.m.

  2. APPROVAL OF MINUTES

    April 26, 2004:  Polly Moutevelis-Burgess moved and Cynthia Woodard seconded to approve the minutes with corrections.  Motion passed unanimously.

    May 24, 2004:  Cynthia Woodard moved and David Bellville seconded to approve the minutes of May 24, 2004 with corrections.  Motion passed unanimously.

  3. DISCUSSION

    Trottier Case: Ted Chaffee called to order the discussion of the approval of a consent agreement in case of COU-112.  There have been discussions between Jim Smith the hearing officer, the AAGs office, and the licensee’s lawyer.  Judy Peters outlined the details of the proposed consent agreement.  This complaint is matter of a female licensee that has been accused by a male client of having a long time sexual relationship.  The original consent agreement included four violations with sanctions.  The board had rejected a proposal by the licensee to no admission but surrender of the license. There is now a counter-proposal to admit to dual relationship and engaging in sexual activities, also an agreement to a reprimand and a permanent surrender of the license.  Polly Moutevelis-Burgess moved to accept the counter proposal as expressed by Judy Peters.  Cindy Woodard seconded.  Motion passed with 7 in favor and 1 recusal (Cheryl Davis).

  4. REMAND HEARING

    Michelle Cobb:  Hearing was recorded and transcribed by a court recorder from Alley Morrissette.  At the conclusion of the hearing, the board voted 3-1 that it interprets its statute and rules to mean that to diagnose is to diagnose a mental health disorder and that the DSM-IV is the exclusive diagnostic tool – thereby Ms. Cobb practiced outside of her LPC license by rendering two DSM-IV diagnoses for two minor children.  The board upheld its original sanctions with amendments to the cost of hearing ($1,500.00) and to require 30 hours of consultation to include issues of ethical/legal considerations of practice as concerns common nomenclature of mental health disorders.

  5. ADMINISTRATOR'S COMMENTARY

    Penny gave a financial update.  The Board asked questions regarding the expenses per meeting.

    Penny gave an update on the draft rules status. 

    Cathy Neuman gave an example of how the complaint office works and provided a status form.

  6. MISCELLANEOUS

    Reid Stevens asked questions regarding The Board of Alcohol and Drug’s new rule regarding supervision and supervision training, also the posting of a consent and fine of a LCPC and LCSW on the Board’s website regarding unlicensed practice that was found to be a mistake.  Scott Hutcherson provided some insight on what was trying to be accomplished by the Alcohol and Drug Board regarding supervision. Kathy provided information regarding an administrative consent agreement.

  7. COMPLAINT UPDATES

    COU-109/116:  Polly Moutevelis-Burgess moved and Scott Hutcherson seconded to approve pending a letter of intent.  Motion passed with 6 in favor and 1 recusal (Cheryl Davis).  Reid Stevens was not present.

    COU-083:  David Bellville moved and Karen St. Clair seconded that further information is needed.  Motion passed with 6 in favor and 1 recusal (Cheryl Davis).  Reid Stevens was not present.

    COU-122:  Polly Moutevelis-Burgess moved and Karen St. Clair seconded to close the complaint.  Motion passed with 6 in favor and 1 recusal (Cheryl Davis).  Reid Stevens was not present.

    COU-120:  A registered counselor that had been offered a consent agreement with two violations and supervision and a fine.  The Counselor has agreed to surrender the registration and never seek registration or licensure again.  Polly Moutevelis-Burgess moved and Karen seconded to accept this proposal.  Motion passed with 5 in favor and 2 recusals (Cheryl Davis and David Bellville).  Reid Stevens was not present

  8. ADJOURN

     --The meeting adjourned at 4:00 p.m.
