Minutes of August 23, 2004 Public Board Meeting

  1. CALL TO ORDER

    The Board was called to order by Ted Chaffee, Chair at 8:28 a.m.

  2. OLD BUSINESS

    1. Approval of July 26, 2004 Minutes

      Cheryl Davis made a motion to approve the minutes of the July 26, 2004 meeting as amended. The motion was seconded by Karen St. Clair.
      Vote:  6 – In favor

  3. NEW BUSINESS

    1. Director’s Commentary

      Anne Head addressed the board regarding a personnel matter

    2. Administrator’s Commentary

      Penny Vaillancourt reported that the board received a communication from NBCC that would allow 3rd party verification of examination scores. There are currently 29 states participating in this program. The board is requesting Ms. Vaillancourt to contact NBCC to obtain further information. Ms. Vaillancourt also supplied the board with a draft copy of the rules for review and discussion at the September 20, 2004 meeting.

    3. Application and Continuing Education Review

      Cheryl Davis made a motion to accept the applications as approved. The motion was seconded by Polly Moutevelis-Burgess.
      Vote: 6 – In favor

      Reid Stevens made a motion to deny applications as reviewed. The motion was seconded by Karen St. Clair.
      Vote: 6 – In favor

      Reid Stevens made a motion to approve applications pending receipt of the required additional information. The motion was seconded by Karen St. Clair.
      Vote: 6 – In favor

      Reid Stevens made a motion to accept the withdrawal of a pending application for Patrician Moran and to approve her application for licensure as a LCPC via the pathway of being licensed in another jurisdiction for five or more years. The motion was seconded by Polly Moutevelis-Burgess.
      Vote: 6 – In favor

      Reid Stevens made a motion to accept the rules and statute as being substantially equivalent for the following states: NH, MA, & WI and to table NM until the next meeting. The motion was seconded by Polly Moutevelis-Burgess.
      Vote: 6 -  In favor

    4. Svetlana Beattie Appeal Hearing – 9:00 a.m.

      Hearing was called to order at 9:10 a.m. Svetlana Beattie was not represented by counsel. There were no objections to individuals present nor were there objections to any of the exhibits.
      Hearing was closed at 9:42 a.m. and deliberations began immediately. Cheryl Davis made a motion to uphold the denial on both grounds. The motion was seconded by Reid Stevens.
      Vote: 6 – In favor

    5. Complaint Presentations

      COU – 123
      A complaint filed against an LCPC by an ex-spouse.  Cynthia Woodard made a motion to dismiss the matter as no violation of the laws or rules have occurred. The motion was seconded by Reid Stevens.
      Vote: 4 - In favor       2 - Recused (Polly Moutevelis-Burgess & Cheryl Davis)

      COU – 125
      A complaint filed against an LCPC by a former client.  Reid Stevens made a motion to dismiss the matter as there were no violations of laws and rules, and to issue a letter of guidance that addresses the issues of client confidentiality. The language will be provided by the complaint officer and Judith Peters. The letter will remain in the file for a period of 10 years. The motion was seconded by Cynthia Woodard.
      Vote: 5 - In favor       1 – Recused (Cheryl Davis)

    6. Complaint Correspondence

      COU-96 & 99
      Judy Peters, AAG, will draft a letter to the licensee and consultant regarding treatment plans.

      COU – 109 & COU – 116
      Cynthia Woodard made a motion not to reconsider the board’s decision regarding its denial of a proposed supervisor consultant. The motion was seconded by David Bellville.
      Vote: 6 – In favor

    7. Correspondence

      Matt Lovering responded to the board’s request for information regarding the use of an on-line consulting webpage.  The board accepted Mr. Lovering’s written representation that the website was no longer active and was intended to be used once licensed by the board.  – Ted Chaffee to respond.

    8. Miscellaneous

      Supervisor Approvals

      Barbara Finch – Motion to approve past supervisor and request documentation of a new supervisor was made by Karen St. Clair. The motion was seconded by Cynthia Woodard.
      Vote: 6 – In favor

      Inactive Status

      No requests for inactive status were presented this month.
