Minutes of November 15, 2004 Public Board Meeting

  1. CALL TO ORDER

    The meeting was called to order by Ted Chaffee, Chair at 9:05 a.m.

  2. OLD BUSINESS

    1. Approval of October 25, 2004 Minutes
      Cynthia Woodard made a motion to approve the minutes of the October 25, 2004 meeting as amended. The motion was seconded by Cheryl Davis.
      Vote:  5 – In favor

  3. NEW BUSINESS

    1. License Denial Hearings

      Robin Duplessis – 9:00 a.m.

      The hearing was called to order at 9:19 a.m. The applicant was not represented by legal counsel.
      The hearing was closed at 9:43 a.m. and deliberations immediately followed.

      Cynthia Woodard made a motion to uphold the board’s denial of LCPC-Conditional application and examination based on #1 and to overturn the denial for #2. The motion was seconded by Cheryl Davis.
      Vote: 5 – In Favor

      Laura Cianchette – 10:00 a.m.

      The hearing was called to order at 10:01 a.m. The applicant was not represented by legal counsel.
      The hearing was closed at 10:15 a.m. and deliberations immediately followed.

      Cheryl Davis made a motion to uphold the board’s denial of LCPC-Conditional application and examination based on #2 and to overturn the denial based on #1. The motion was seconded by Reid Stevens.

      Vote: 4 – In Favor     1 – Opposed (David Bellville)

    2. Administrator’s Report

      Penny Vaillancourt provided the board members with a financial update.

      Ms. Vaillancourt also notified the board that Polly Moutevelis-Burgess is willing to attend the annual conference. The board members indicated that they previously decided to rotate board members and that a different board member should attend.

      Cheryl Davis made a motion to send David Bellville to the AASCB (American Association of State Counseling Boards) Annual Conference in Savannah, Georgia from January 13-15, 2005.  The motion was seconded by Cynthia Woodard.

      Vote: 5 – In favor

    3. Complaint Items

      There were not complaint matters for discussion/action.

    4. Draft Rules Review/Discussion

      The board discussed the draft rules as presented by Jeff Frankel.  The board offered suggested changes to which Jeff Frankel will make and incorporate into the current draft.  The board will receive the updated draft rules for discussion at the December board meeting. 

    5. Correspondence
      Janet Tunis – Penny Vaillancourt to draft a response for Ted Chaffee’s review and signature regarding an inquiry regarding obtaining parental consent prior to 3rd party billing.  After a thorough discussion of the issue, the board determined that while it cannot give legal advice to the licensee regarding school policies and procedures, that it will remind the licensee of the standards of practice and code of ethics regarding patient confidentiality and parental consent of treatment of minors.

        Cindy Woodard made a motion to accept the supervisor approvals upon Ted Chaffee’s review and approval.  The motion was seconded by David Bellville.
        Vote:  5 – In Favor

      2. Inactive Status

        No requests for inactive status this month

    7. Application and Continuing Education Review

      LCPC
      Mary Domareki – Re-Review

      Cindy Woodard made a motion to revise the denial of licensure based on post-master’s supervision hours. The motion was seconded by Cheryl Davis.
      Vote: 5 – In Favor

      Todd Dubose – Denied

      David Bellville made a motion to deny the application for LCPC licensure due to lack of official transcript and to continue review of core and additional content educational requirements for licensure. The motion was seconded by Cynthia Woodard.
      Vote: 5 – In Favor

      LCPC Conditional
      Kristin Cudmore – Re-Review

      David Belville made a motion to overturn the denial of licensure based on submission of additional documentation on coursework. The motion was seconded by Cheryl Davis.
      Vote: 5 – In Favor

      LPC Conditional
      Edward Stevens – Re-Review

      David Belville made a motion to overturn the denial of licensure and examination based on submission of additional course content as described in course syllabus. The motion was seconded by Cheryl Davis.
      Vote:   5 – In Favor

      Registered Counselors
      Bonnie Gibson – Approved by staff
      Cindy Mason – Approved pending receipt of revised disclosure statement per staff review.

      Renewal Applications
      Kim Tousignant – The board tabled the renewal application pending additional information on the completion of continuing education activities.

    The next meeting is scheduled for December 20, 2004.
