Minutes of August 22, 2005 Public Board Meeting

The meeting was called to order by Theodore Chaffee, Chair at 8:53 a.m.

- Approval of July 25, 2005 Minutes
Polly Moutevelis-Burgess made a motion to approve the July 25, 2005 minutes as amended. The motion was seconded by Cynthia Woodard.

- Administrator’s Report
Rules
Penny Vaillancourt indicated that a mass mailing is being generated to notify licensees of the new rules, as well as interested parties. A financial update was provided, as well as an explanation to the standing Executive Order on Out of State Travel. An update regarding the online renewal system was also provided. Penny Vaillancourt will be working with Jeff Frankel, OLR Staff Attorney to determine a date to meet to begin the rulemaking effort for the remaining board chapters 7-10.
- License Denial Hearings

Licensee was represented by counsel, Emily Bloch, Esq.
The hearing began at 11:00 a.m. for the purpose of the board reviewing additional evidence and testimony from the applicant regarding the board’s initial denial of application for licensure as an LCPC-Conditional. Cheryl Davis made a motion to grant the appeal on ground #4 and to uphold the denial based on grounds #1, #2, and #3. The motion was seconded by Polly Moutevelis-Burgess.

COU – 119 – Broche
The Board noted that information had been received and that the consultant had been approved.
- Complaint Presentations 1:00
COU – 134 – Complaint filed against a LCPC alleging unprofessional conduct.
Polly Moutevelis-Burgess made a motion to dismiss the complaint because the allegations did not rise to the level of a violation, but to issue a letter of guidance regarding the breach of confidentiality to be drafted by the AAG and the Complaint Officer, which will stay in the licensee’s file for ten years. The motion was seconded by Karen St. Clair.

COU – 126 – Complainant filed by a Guardian Ad Litem against a LCPC alleging unprofessional conduct.
Polly Moutevelis-Burgess made a motion to table the complaint pending the receipt of additional information. The board is requesting information regarding the licensee’s expertise, training, and education in the treatment/diagnosis of sexual abuse victims. The board is also seeking information regarding clinical supervision regarding this practice. The motion was seconded by Cynthia Woodard.

Judith Gardner, M.D. – requesting board guidance/clarification regarding clinical work in a setting that is being performed by Patrick Young.
Karen St. Clair made a motion to approve sending a letter asking for more information. Cheryl Davis seconded the motion.
