Minutes of September 19, 2005 Public Board Meeting

Members Present:

  • Theodore Chaffee, Board Chair (left at 11:00 a.m.)
  • Karen St. Clair
  • Cheryl Davis
  • David Bellville
  • Cynthia Woodard

Others Present:

  1. CALL TO ORDER
    The meeting was called to order by Theodore Chaffee, Chair at 9:00 a.m.

  2. OLD BUSINESS
    1. Approval of August 22, 2005 Minutes

      Cheryl Davis made a motion to approve the August 22, 2005 minutes as amended.  The motion was seconded by Karen St. Clair.
      Vote: 4 In Favor  (1 recused – David Belville)

  3. NEW BUSINESS

    1. Administrator’s Report

      Penny Vaillancourt discussed staffing changes within the work group.  She also provided the board with the Governor’s Executive Order regarding Hurricane Katrina.

      The board’s rules committee is scheduled to meet on Friday, October 7 to discuss the remaining Chapters 7-10 for revision.

    2. License Denial Hearings

      Nathan Hallowell

      Licensee was not represented by counsel.  The hearing began at 9:30 a.m.

      The hearing was closed and the board deliberated.  Cheryl Davis made a motion to uphold the denial of the Human Growth & Development course.  No second to the motion – motion fails.

      Cynthia Woodard made a motion to overturn its earlier denial and grant the appeal with respect to Human Growth & Development course.  Karen St. Clair seconded the motion.

      David Belville made a motion to uphold the denial of Lifestyle and Career Development.  Seconded by Cheryl Davis.
      Vote: 5- In Favor

      Jennifer Hallowell

      Licensee was not represented by counsel.  The hearing began at 10:30 a.m.

      The hearing was closed and the board deliberation.  Cynthia Woodard made a motion to overturn its earlier denial and grant the appeal of the Human Growth & Development course.  Karen St. Clair seconded the motion.
      Vote: 4 – In Favor, 1 – Opposed (Cheryl Davis)

    3. Complaint Items

      COU-109 & COU-116 – Review Quarterly Report

      Cynthia Woodard made a motion to accept the quarterly report and to close the matter.  Karen St. Clair seconded the motion.

      Vote: 4 – In Favor 1 – Recused (Cheryl Davis)

    4. Complaint Presentations 1:00

    5. Correspondence
      Emily Bloch, Esq. – re: Rebecca Murphy License Denial Hearing.  Judy Peters to respond, Penny Vaillancourt and Ted Chaffee to review

      Discussion of board meeting start time – keep at 8:30 a.m.

    7. Applications

      Karen St. Clair made a motion to accept applications as approved and denied as presented.  The motion was seconded by Cynthia Woodard.

      Vote:  Unanimous

      Inactive status

      Jennifer Baker – granted – send letter that inactive status cannot be retroactive but will go forward from this point to renewal.  Cheryl Davis made a motion to grant inactive status.  Karen St. Clair seconded the motion.
      Vote: Unanimous
