Minutes of October 31, 2003 Public Board Meeting

  1. CALL TO ORDER

    Cecilia Ohmart, Chair, called the meeting to order at 9:00 a.m.

  2. APPROVAL OF MINUTES

    In a motion by Donna Dugal, seconded by Joan Herzog, the Board voted unanimously to approve the minutes of the May 2, 2003 meeting as written.

  3. ELECTION OF OFFICERS

    A motion was made by Donna Dugal to re-elect Cecilia Ohmart as Chair.  The motion was seconded by Joan Herzog.

    A motion was made by Cecilia Ohmart to re-elect Joan Herzog as Complaint Officer.  The motion was seconded by Donna Dugal.

    A motion was made by Cecilia Ohmart to re-elect Donna Dugal as Secretary.  The motion was seconded by Joan Herzog. 

    In a motion by Donna Dugal and seconded by Joan Herzog, the board voted unanimously to re-elect the slate of officers as previously motioned.

  4. APPROVAL OF APPLICATIONS

    In a motion by Joan Herzog, seconded by Donna Dugal, the Board voted unanimously to approve the following licenses that were issued since the May 2, 2003 meeting:

    Kelly J. Angotti – Temporary Dietitian
    Andrea L. Byther – Temporary Dietitian
    Tama Catell – Temporary Dietitian
    Francie Conley – Dietetic Technician
    Constance Fortin – Dietetic Technician
    Amy L. George – Dietetic Technician
    Elaina S. Hopkins – Temporary Dietitian
    Lisa A. Jensen – Dietetic Technician
    Johanna Melchiore – Dietitian
    Karen D. Schilling – Temporary Dietitian
    Jennifer L. Swift – Dietetic Technician
    Brianne Verrill – Temporary Dietitian
    Jody E. Vlodek Berren – Dietitian
    Meredith B. Wood – Temporary Dietitian

    In a motion by Donna Dugal, seconded by Joan Herzog, the Board voted unanimously to approve an application for Elizabeth G. Bertolone for licensure as a Dietitian pending receipt of a satisfactory verification of licensure from Massachusetts.

  5. REVIEW OF APPLICATIOIN FOR LICENSURE RENEWAL

    The Board reviewed the application for the renewal of Paetra A. Estes’ license as a Dietetic Technician.  This application was received on December 18, 2002 along with a request for a waiver of the required four (4) hours of Category I continuing education.  At its May 2, 2003 meeting, the Board considered this request and concluded that it was without authority to waive the requirement that Ms. Estes obtain four (4) hours of Category I continuing education.  However, instead of denying this application for re-licensure, the Board voted to offer a Consent Agreement in which they would grant an extension of time to complete the required Category I continuing education needed for renewal of this license.  This Consent Agreement was forwarded to Ms. Estes on May 7, 2003 and the Board did not receive a response from Ms. Estes.

    In a motion Joan Herzog, seconded by Donna Dugal, the Board voted to preliminarily deny Ms. Estes’ application for the renewal of her license based upon her failure to complete the continuing education required for re-licensure pursuant to 32 M.R.S.A. § 9909(2) and Board Rules, Chapter 2, Section 2(C)(2) and Section 3(B).  Ms. Estes will have the right to appeal the decision of the Board by filing a written request for an adjudicatory hearing within 30 days of receipt of her notice of denial.

  6. DISCUSSION REGARDING CONTINUING EDUCATION

    The Board discussed its requirements for continuing education and what is considered to be an appropriate activity.  The Board also reviewed requirements from other states as well as those from other boards within the Office of Licensing and Registration.  The Board’s law states that continuing education must be germane to the profession and therefore, the Board cannot alter its rules in any way.  However, when reviewing continuing education, if there is a question as to the applicability of a program, the Board will request additional information from the licensee for further review of the program in question.

  7. ADMINISTRATOR’S REPORT – PENNY VAILLANCOURT

    Penny Vaillancourt presented a financial analysis of the Board’s revenue and expenses at the current fee schedule and at a proposed fee decease schedule.

    The Department of Professional and Financial Regulation is reviewing a proposal to reduce licensing fees for the next renewal cycle.  The proposal is to decrease the licensing fees to $70.00 for Dietitians and Dietetic Technicians and to reduce the temporary license to $50.00.  It is anticipated that a public hearing on this proposed rule will be held sometime in December or January.

  8. INTRODUCTION OF COMMISSIONER ROBERT MURRAY

    The Board was introduced and spoke briefly with Commissioner Robert Murray.

  9. ADJOURNMENT

    There being no further business, the meeting was adjourned at 12:00 p.m.
