Minutes of September 11, 2003 Board Meeting

 

 

Members Present:               Robert Barnes, Chair; Hervey Clay, Complaint Officer, Paul Fredette, Jennifer Minkowitz, Bethel Shields, John Dunn, Ernest Marriner and Normand Lambert

 

Others Present:                    Penny Vaillancourt, Administrator; Judith Peters, Assistant Attorney General; Matthew Cyr, Board Inspector and Diane Bradstreet, Board Clerk

 

Members Absent:                 None

 

CALL TO ORDER

 

Robert Barnes, Chair, called the meeting to order at 9:00 a.m.

 

APPROVAL OF MINUTES

 

In a motion by Normand Lambert, seconded by Bethel Shields, the minutes from the August 14, 2003 meeting were unanimously approved as written.

 

COMPLAINT PRESENTATION

 

Complaint #F-239 was presented to the Board by Judith Peters, Assistant Attorney General and Matthew Cyr, Board Inspector.

 

In a motion by Bethel Shields, seconded by John Dunn, the Board voted unanimously to table this complaint pending receipt of additional information.  

 

REVIEW OF INSPECTION REPORT FORM

 

The Board reviewed and made additional changes to the revised inspection report form.  In a motion by Bethel Shields, seconded by Normand Lambert, the Board voted unanimously to accept the form as amended. 

 

DISCUSSION REGARDING PUBLIC LAW 109

 

Penny Vaillancourt presented for Board review a notice drafted for notification of Public Law 109, An Act Regarding Mortuary Trusts.  In a motion by John Dunn, seconded by Paul Fredette, the Board voted unanimously to approve the notice as amended.  This notice will be mailed to all licensed practitioners and directors and will be included in all informational packages.

UPDATE ON NATIONAL CONFERENCE EXAMINATION

 

The National Conference Examination is now finalized and is ready for administration.  In a motion by Hervey Clay, seconded by John Dunn, the Board voted unanimously to start using this new examination and to have the Office of Licensing and Registration schedule the dates for administration.  A notice will be sent to the Maine Funeral Directors Association and to all licensees notifying them of the new examination and of the references used to develop the examination.

 

CONTINUING EDUCATIONAL APPROVAL

 

In a motion by Hervey Clay, seconded by Paul Fredette, the Board voted unanimously to approve the attached list of continuing education approvals as reviewed by the Continuing Education Committee at today’s meeting.   

 

ADMINISTRATOR’S REPORT – PENNY VAILLANCOURT

 

Ms. Vaillancourt informed the Board that a public hearing was held on July 31, 2003 on the Office of Licensing and Registrations’ proposed rule, “Uniform Rule for the Substantiation of Continuing Education Requirements.”  This rule went into effect on August 19, 2003.

There being no further business, in a motion by Normand Lambert, seconded by Jennifer Minkowitz, the meeting was adjourned at 11:30 a.m.
