Minutes of January 10, 2006 Public Board Meeting

  1. CALL TO ORDER
    Robert Barnes, Chair, called the meeting to order at 9:00 a.m.

  2. OLD BUSINESS
    1. In a motion by Normand Lambert, seconded by Paul Fredette, the minutes from the December 13, 2005 meeting were unanimously approved as written.

  3. NEW BUSINESS

    1. REVIEW AND ACTION ON CEU AUDIT FOR 2004 - 2005
      In a motion by Normand Lambert, seconded by Bethel Shields, the board voted to approve the attached list of 2004 – 2005 CEU audits.  All in favor with one recused (Paul Fredette).

    2. APPROVAL OF DECEMBER CONTINUING EDUCATION PROGRAMS

      In a motion by Bethel Shields, seconded by John Dunn, the Board voted unanimously to approve the list of continuing education programs as reviewed by the Continuing Education Committee at it December 13, 2005 meeting.

    3. CHAIR’S REPORT – ROBERT BARNES

      Mr. Barnes reported on his recent trip to Montpelier, Vermont.  In his role as District 1 Governor for the International Conference of Funeral Service Examining Board, Inc. (ICFSEB) Mr. Barnes visited Vermont to discuss issues associated with the purpose and mission of ICFSEB, as well as provide updates on current issues in his role as District I Governor.  Mr. Barnes is scheduled to visit Rhode Island on February 27, 2006.

    4. ADMINISTRATOR’S REPORT – PENNY VAILLANCOURT

      Penny Vaillancourt reported on the following:

      • Dates will be scheduled for the rules committee to meet;
      • Update on the number of licensees;
      • Fifteen (15) establishments are currently pending inspections;
      • An attempt will be made to have the survey results ready for the February board meeting; and
      • The expiration date for all funeral licenses/registrations will be changed to an annual date of February 28th  - leap years will be February 29th.

    5. ADJUDICATORY HEARING ON COMPLAINT #FUN-235

    6. ADJUDICATORY HEARING ON COMPLAINT #FUN-274

      A hearing was conducted to determine whether grounds existed for the board to take disciplinary action against the licensee in Complaint #FUN-274. The hearing was held to determine whether this licensee violated 32 M.R.S.A. § 1455-A (K), (M), and 22 M.R.S.A. § 2843-A for unprofessional conduct by engaging in negligence or misconduct in carrying on the business or profession of funeral service.

      At the conclusion of the hearing, a motion was made by Normand Lambert, seconded by John Dunn to dismiss the complaint against the licensee. Vote: 4 in Favor, 1 Opposed (Bethel Shields) and 1 Recused (Hervey Clay).

    7. APPROVAL OF APPLICATIONS

      Ethan L. Annis – The application of Mr. Annis seeking licensure as a practitioner trainee was reviewed. A motion was made by Hervey Clay, seconded by Paul Fredette, to approve this application. Vote: 6 Opposed. Motion defeated.

      In a motion by Normand Lambert, seconded by Paul Fredette, the board voted unanimously to table this application until a background check is completed on Mr. Annis.

  4. ADJOURN

    There being no further business, the meeting was adjourned at 4:00 p.m.
