RULE-MAKING ACTIVITY:
CHAPTER 201:
Fishing on Waters under jurisdiction of Maine Indian Tribal-State Commission
STATUTORY OR OTHER BASIS: 30 MRSA §6207(3)
PURPOSE OF THE RULE: To license commercial activities on waters under
the jurisdiction of Maine Indian theTribal-State Commission and other
issues that the State and the Tribes agree need to be addressed.
SCHEDULE FOR ADOPTION: Spring/Summer 2002. Note: MITSC had planned to
adopt this rule this past year, but did not. It is back on the agenda
for the coming year.
LISTING OF AFFECTED PARTIES: Potentially benefited and regulated parties
include Passamaquoddy and Penobscot Tribal Members, as well as non Tribal
Members who fish on MITSC waters.
CONSENSUS-BASED RULE DEVELOPMENT: Information on any planned use of
MITSC is premised on the concept of consensus. Adoption of MITSCs rules
cannot occur unless there is agreement by the State of Maine, the Passamaquoddy
Tribe, and the Penobscot Nation.
