NOTICE OF STATE RULE-MAKING
Public Input for Proposed and Adopted Rules
Notices are published
each Wednesday to alert the public regarding state agency rule-making.
You may obtain a copy of any rule by notifying the agency contact person.
You may also comment on the rule, and/or attend the public hearing.
If no hearing is scheduled, you may request one -- the agency may then
schedule a hearing, and must do so if 5 or more persons request it.
If you are disabled or need special services to attend a hearing, please
notify the agency contact person at least 7 days prior to it. Petitions:
you can petition an agency to adopt, amend, or repeal any rule; the
agency must provide you with petition forms, and must respond to your
petition within 60 days. The agency must enter rule-making if the petition
is signed by 150 or more registered voters, and may begin rule-making
if there are fewer. You can also petition the Legislature to review
a rule; the Executive Director of the Legislative Council (115 State
House Station, Augusta, ME 04333, phone 207/287-1615) will provide you
with the necessary petition forms. The appropriate legislative committee
will review a rule upon receipt of a petition from 100 or more registered
voters, or from "...any person who may be directly, substantially and
adversely affected by the application of a rule..." (Title 5 Section

Certification
ADOPTED RULE NUMBER: 2004-P319
CONCISE SUMMARY: The Maine Department of Corrections is adopting a proposal
to revise the existing standards for the certification of batterer intervention
programs pursuant to 19-A MRSA §4014 (1) to revise the Standards as
a result of the 2004 biannual review. The Maine Department of Corrections
developed the proposed rules in consultation with the Maine Commission
on Domestic and Sexual Abuse in accordance with the provisions of 19-A
MRSA §4014(l). The proposed revisions to the Batterer Intervention standards
will result in improved operation of the Batterer Intervention Programs.
THIS RULE WILL NOT HAVE A FISCAL IMPACT ON MUNICIPALITIES.

RULE TITLE OR SUBJECT: Amendment to Ch. 1294, State-imposed Shoreland
Zoning Map for the Town of Farmingdale
PROPOSED RULE NUMBER: 2004-P321
CONCISE SUMMARY: This rule will amend the official shoreland zoning
map for the town of Farmingdale, pursuant to its state-imposed shoreland
zoning ordinance. The Department of Environmental Protection is proposing
to change the districting from the Limited Residential District to the
Limited Commercial District along Route 201 from the Gardiner city line
to where that road exits the shoreland zone (250 feet from the river).
The amendment will also create a Limited Commercial District within
250 feet of Route 201 along the stream at the northern end of town.
The proposed changes are proposed in recognition of the commercial development
already in the area.
The Department is also proposing to create a General Development District
at the site of Ferraiolo Construction where an industrial activity has
been in place for a significant period of time. The Ferraiolo site,
where it extends into the shoreland zone is currently zoned for residential
development.
THIS RULE WILL NOT HAVE A FISCAL IMPACT ON MUNICIPALITIES. Any impact
will be minimal.
