Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone 207/287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." ADOPTED RULE NUMBERS: 2006-355 through 358
CONCISE SUMMARY: The amendments include an addition to ethical standards of practice for installers, removers, and inspectors, to require certified persons having knowledge of violations of the Board’s enabling statute to provide the Board information and assistance necessary to the final determination of such violation They also include revisions to the certification processes for installers, removers, and inspectors to allow the Board to examine and evaluate an applicant’s record with its own files and other government agencies in addition to the State Police and other licensing boards to evaluate the applicant’s ethical practice. Finally, they enact procedural provisions to specify how an applicant may obtain their examination scores and review their papers relating to their examination.

CHAPTER NUMBER AND TITLE: Ch. 157, The Administration of Over Dimension and Overweight Permits
CONCISE SUMMARY: This amendment implements the provisions of R189, allowing oversized timber harvesting equipment to be moved at night under certain conditions in March and April. The rule makes minor technical corrections.
CHAPTER NUMBER AND TITLE: Ch. 170, Pilot Project to Allow Commercial Vehicles at the Canadian Weight Limits to Travel from the Canadian Border at Calais to Baileyville and Van Buren
CONCISE SUMMARY: This amends the Canadian Weight limit rule adopted pursuant to Chapter 421, PL 2005 to add a new route from the Canadian border at Van Buren to the Bangor & Aroostook rail yard.

CONCISE SUMMARY: This Chapter describes how natural gas utilities serving more than 5,000 residential customers must implement natural gas energy conservation programs.

AGENCY: 04-059 - Department of Conservation, Bureau of Parks and Lands
CHAPTER NUMBER AND TITLE: Ch. 54, Bear Baiting on Public Lands
CONCISE SUMMARY: The Bureau of Parks and Lands has amended its rules on bear baiting to: require applicants to disclose any business relationship with guides, sporting camps or outfitters engaged in the same business; require listing the name of any person authorized to bait sites if other than the applicant; increase bear bait site fees to $30 for personal sites and $65 for commercial sites; prohibit hunting guides from obtaining personal sites, and removing a confusing statement from regarding bait site allocation.

CHAPTER NUMBER AND TITLE: Ch. 182, Formula for Distribution of Funds to Child Development Services Regional Sites
CONCISE SUMMARY: This emergency major substantive rulemaking amends the current Department of Education Regulation in the following areas:
- Deletes the State set aside for training, staff development, and capital improvement
- Amends the method of distribution for Administrative and Direct services for FY 07
- Deletes the language regarding a phase in
- Revises the targeted needs section to be articulated as Hardship funds and deletes a Peer review
