NOTICE OF STATE RULE-MAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone 207/287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." RULE TITLE OR SUBJECT: Ch. 19, Homeless Programs Rule
PROPOSED RULE NUMBER: 2007-P1
CONCISE SUMMARY: The purpose of the proposed amendment to the Homeless Programs Rule is to implement the basic criteria for determining eligible recipients and the funding methodology developed by the Statewide Homeless Council. The amendment also makes minor technical changes to the rule.
THIS RULE WILL NOT HAVE A FISCAL IMPACT ON MUNICIPALITIES.

RULE TITLE OR SUBJECT:
Amendment to Ch. 252, Rules Governing Certification of Seed Potatoes in the State of Maine
Amendment to Ch. 255, Imported Seed Potatoes
PROPOSED RULE NUMBER: 2007-P2, P3
CONCISE SUMMARY: The Department is proposing to amend these two chapters as follows: (1) to amend Ch. 252 to address an increasing incidence of Bacterial Ring Rot Disease (BRR) by requiring testing of all other seed lots on a farm where BRR has been detected before the grower may sell or plant them as seed; (2) to amend Ch. 252 to improve the financial stability of the Seed Certification Program by increasing the entrance fee from $24.00 to $26.00 per acre; and (3) to amend Ch. 255 to improve the financial stability of the Seed Certification and have all growers contribute a fair share by increasing the import fee to $25.00 per application plus an additional $0.20 per hundred weight except the additional per hundred weight fee is not charged when the application is for mini-tubers or plantlets.
THESE RULES WILL NOT HAVE A FISCAL IMPACT ON MUNICIPALITIES.

CONCISE SUMMARY: Rule 302 has been in place for many years and serves to explain the administration of sales tax exemptions pertaining to government agencies and exempt organizations. Various minor amendments have been made as part of a general review of Maine Revenue Services rules. None of the proposed amendments changes current administrative practice.
