NOTICE OF STATE RULE-MAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone 207/287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." CONCISE SUMMARY: In accordance with the legislative repeal of the elver license lottery, the elver lottery regulations would be repealed for compliance with 12 MRSA 6505-A, sub-2, effective April 4, 2006. CONCISE SUMMARY: These proposed regulations would adopt, through the regular rule-making process, changes that become effective with the adoption of the emergency rules establishing the 2007 2008 shrimp season. The proposed season would take place from December 1, 2007 through April 30, 2008. The season for the harvest of shrimp by trawl and by trap would be the same dates.

RULE TITLE OR SUBJECT: Ch. 50.02, Spiny Dogfish, Harvest, Possession and Landing Restrictions clarification
PROPOSED RULE NUMBER: 2007-P322

RULE TITLE OR SUBJECT: Ch. 45.05(1)(A)(2), Shrimp Season, 2007 2008, Emergency regulations
ADOPTED RULE NUMBER: 2007-496
CONCISE SUMMARY: These emergency regulations begin the process of establishing the 2007 2008 Northern Shrimp season in compliance with the Atlantic States Marine Fisheries Commission Northern Shrimp Fishery Management Plan set November 14, 2007. The season shall take place from December 1, 2007 through April 30, 2008. The season for the harvest of shrimp by trawl and by trap shall be the same dates.
A public hearing will be held in the affected area if requested of the Commissioner in writing by 5 persons. The hearing will be held within 30 days of the Commissioner receiving the written requests.

CHAPTER NUMBER AND TITLE: Ch. 216, Rules Governing the Sale of Dogs and Cats and Importation of Dogs and Cats for Resale or Adoption
ADOPTED RULE NUMBER: 2007-497
CONCISE SUMMARY: This rule is proposed to be modified to include new standards for the importation of dogs and cats for adoption as well as new testing requirements for dogs and cats imported into Maine for resale or adoption. The reason for making these rule changes is: 1) To protect the health of Maine's resident dog and cat population; 2) To provide more comprehensive standards for the health of the animals being transported into Maine for resale or adoption; and 3) To enhance consumer protection by ensuring a more healthy pool of dogs and cats being imported for resale or adoption.
