In 1997, the Maine Legislature, with the support of Governor Angus S.
King, Jr., enacted Public Law 1997, Chapter 486 to establish a Monitoring,
Audit, and Enforcement ("MAE") Program. The basic goals of this program
are to (1) provide timely and reliable data to policymakers; (2) monitor
and audit payments and filings; and (3) identify insurers, self-insurers,
and third-party administrators (collectively "insurers") that are not
complying with minimum standards.
As part of the monitoring program, the Board, among other things, identifies
employers that do not have required coverage and identifies First Reports
of Injury that are filed late. Audits are being conducted pursuant to
a yearly schedule. The Board's Abuse Investigation Unit provides an enforcement
mechanism when violations of the Workers' Compensation Act are identified.
