Pursuant An Act Relating to Net Energy Billing and Distributed Solar and Energy Storage Systems. Public Law 2023, Chapter 411   (Act)*, the Maine Public Utilities Commission (MPUC) is seeking proposals from qualifying distributed generation resources (DG resources) for the sale of energy and/or renewable energy credits (RECs). To be a qualifying DG resource, a generation facility must meet the requirements as defined in the Act. Specifically, a DG resource means an electric generating facility that uses renewable fuel or technology   under 35-A M.R.S. § 3210(2)(B-3)**,  is located in the service territory of a T&D Utility in the State, and: 

1) Has met or is reasonably likely to meet the requirements of section 3209-A(7)(E)***,  as determined by the Commission; or 

2) Has a nameplate capacity of at least 1 MW and not more than 2 MW and:

     a.) is a member of a cluster study conducted by the T&D utility with which the DG resource is seeking to interconnect; or 

     b.) is likely to receive the required transmission approval from the ISO-NE on or before April 30, 2024.  

    Bidders selected will enter into contract(s) with one or both of Maine’s investor-owned transmission and distribution utilities - Central Maine Power Company (CMP) and Versant Power (VP). A DG Resource that is awarded a contract is ineligible for net energy billing under 35-A M.R.S § 3209-A or § 3209-B (NEB) and any DG Resources awarded a contract shall be required to terminate any NEB agreement(s) as a condition of such award. A contract may be for a term of no more than 20 years unless the Commission finds a contract for a longer term to be in the public interest. Proposals will be evaluated based upon the requirements and objectives stated in the Act and the Request for Proposals (RFP).

    *  The Act will be codified at 35-A M.R.S. § 3209-D.

    ** If the DG resource is a fuel cell, it must be a fuel cell that utilizes a renewable fuel.

    ** Section 3209-A(7)(E) provides that a DG resource that will be used for NEB must, on or before December 31, 2024, reach commercial operation by the date specified in the NEB agreement that it has with the T&D Utility, or by the date specified with an allowable modification to that agreement.
