If parties are unable to resolve their collective bargaining impasse at mediation, fact finding is the next step in the impasse resolution process under Maine's collective bargaining laws. To request fact-finding services from either the Board of Arbitration and Conciliation (BAC) or a private fact-finding panel, please follow these steps:
- Review the MLRB Rules that govern fact finding – see Chapter 13, Sections 21 through 38 of the MLRB Rules.
- Complete and sign MLRB Form 4 (PDF), Request for Fact Finding Panel, in accordance with the rules.
- E-file the request by emailing a copy to mlrb@maine.gov.
- For parties wishing to mutually waive fact finding, please complete MLRB Form 6 (PDF), Mutual Request to Waive Fact Finding, and submit the form by e-file (PDF).
